General Terms and Conditions

1 - Acceptance of conditions

The customer confirms that (s)he has read the terms and conditions stated on this screen during the placement of the order and expressly declares that (s)he accepts them unreservedly. These terms and conditions govern the contractual relations between S.A.S Sodima and its customer, both parties accepting them unreservedly. These terms and conditions will prevail over any other conditions appearing in any other document, unless otherwise previously specified in writing. All Sodima-Rotin-Design customers declare that they have a capacity to contract with the following terms and conditions stated hereafter, have reached the age of majority or are an emancipated minor and not protected in the sense of article 488 of the civil code.

Rotin-Design is the online sales brand for the company Sodima.

3 - Orders and payments

Orders can be made on our website, via mail or by fax.

The date of the order is taken as being:

- The date that the client's order is validated, in the event of payment via debit/credit card online.

- The confirmation date from our bank of the effective payment for the order, for payments made by cheque or by transfer, in the event of orders made via a channel other than the www.rotin-design.com site.

 

Upon their receipt via mail. If that day is a Saturday, a Sunday or a national holiday, this period is extended until the next working day.

 

Orders and payment on the www.rotin-design.com website

The automatic recording systems on our site are considered as proof of the nature, the content and the date of the order.

During the placement of the order, our site indicates the effective delivery schedule of the order and its amount.

After verification and registration of the payment, an order confirmation will be sent to the email address that you have given us.

The purchaser is committed by the information (s)he states when making the order. In case of error in the wording of the recipient's contact details, the vendor will not be held responsible if it is unable to deliver the product.

The secure Rotin-Design website enables payments to be made for orders by entering card details completely securely: these details are encrypted and sent directly to the payment services centre and do not pass through our information server. 
The order will only be valid when the banks involved have given their consent. In the event that the banks decline, the order will be automatically cancelled and the customer informed by email. Moreover, Rotin-Design reserves the right to refuse any order from a client with whom a prior dispute exists.

The amount of your order will be debited from the customer's bank account when validating the order.

Payments by credit card enable the customer to benefit from the possibility to pay in several times without fee (in 3 or 4 times without fee). No formalities or supporting documents are required. The first rate will be debited from the customer's bank account the same day of the order, the second rate after 30 days, the third after 60 days, and - in the case of a payment in 4 fimes - the fourth after 90 days.

Orders via mail, fax or telephone and payment.

After verification, an acknowledgement of receipt of the order will be sent to the email address that you have given us, or failing that to your postal address.
This acknowledgement will specify the delivery lead times and will confirm your order total.

The order will be definitively validated after the payment has been registered (confirmation from our bank that the payment has been processed, or after we have received notice of your bank transfer into our account).

With these payment methods, the option to pay in smaller instalments without fees, offered during promotional periods, is not available.

Rotin-Design can also note down, via mail, fax or telephone, customers' card details and make a secure transaction with the customer's bank. 
After validating a transaction, card details are not stored.
In this way, customers can also benefit from the occasional option to pay in instalments without fees (see durations on the site).
For security reasons, we expressly ask not to receive bank details via email.

4 - Prices

The prices indicated on the site are guaranteed for their online duration.

Prices are in euros and include legal taxes, for France and EEC countries.

Prices are liable to vary during promotional periods (launch of new products, particular operations with suppliers etc.) or during periods of sales.
They include the VAT applicable on the day of the order. 
Any change in the applicable rate will have an effect on the prices of the products. 
Likewise, the establishment of new taxes or obligations or the modification of existing ones, either upwards or downwards, will have an effect on the prices appearing on our site.

The price applicable is the one in force on the site, on the date that the order is registered.
The prices of items cannot be modified once the customer's order has been validated.

5 - Deliveries: organisation, dates and prices

Organisation

Orders are delivered to the customers' home (address provided when the order was made) by independent couriers and these deliveries are subject to a telephone call beforehand.
The furniture that is entrusted to the couriers is checked before leaving our depot, individually wrapped and packed in reinforced cardboard packaging.

The customer must check the complete contents of the parcel when it is received. The courier is bound to stay with the customer during this verification: the customer must note any anomalies noticed on the delivery note so that the courier's insurance can be utilised if there are any problems. If the courier cannot stay for unpacking, you must indicate on the delivery note "subject to control, the courier could not stay for unpacking." This is necessary so that we can provide you with a proper after-sales service in case of problems. In this case, the customers are invited to contact Rotin-Design as quickly as possible, who will take care of the insurance matters with the courier and will offer a new shipment of the customer's order.

Dates

When an order has been validated, S.A.S Sodima Rotin-Design indicates the delivery date for the ordered products.

If S.A.S Sodima is not able to deliver to the customers before the specified date for any reason (lack of availability from the supplier, transport problem etc.), it agrees to inform the customer as soon as it is aware of the impossibility. It will offer the customer the choice of a reimbursement of the full amount spent as soon as possible and within 30 days at the latest, or the creation of a new order. If this new order is for a different total, the customer will have to pay the difference for a more expensive order or will be reimbursed with the difference for a cheaper order.

The standard delivery schedule is the following:

Items in stock:

  • Destination France and Monaco: dispatched in a maximum period of 6 calendar days after the order has been validated;
  • Destination Belgium, Germany and Switzerland: dispatched in a maximum period of 10 calendar days after the order has been validated.

PLEASE NOTE: DUE TO A REDUCED DELIVERY ACTIVITY IN AUGUST, DELIVERY IS LIKELY TO TAKE LONGER THAN USUAL.

Items waiting to be restocked are dispatched as soon as goods are received, in periods that can vary between 2 and 7 weeks for all countries.

Price of delivery

The delivery prices are listed when the order is made on the Rotin-Design website (or during orders over the telephone) and appear on the acknowledgement of receipt of the order and the issued invoice.

The costs of shipping and delivery depend on the value of the order. They vary from one country to another.

The rate for deliveries in France, Belgium, Germany and Switzerland appears in the section "Transport and Delivery".

Deliveries to Switzerland are carried out under the Incoterm DDP, i.e. the goods will be delivered duty paid. Taxes and COD fees must be paid by customers. Please note: COD fees can be avoided if you accept to pay via bank transfer. Specify your wish to pay via bank transfer when you are called by the carrier company to make a delivery appointment.

Rotin-Design can also deliver to countries outside the EC: research will be made into delivery methods and prices before any order is accepted.

These delivery prices can vary due to the evolution of the couriers' conditions.
However the prices indicated in the validation of orders are definitive and cannot be modified once the customer's order is validated.

6 - Guarantees, the return of items

Rotin-Design is committed to respecting the legal guarantee of conformity and the guarantee against hidden defects.

The customer must verify the items when the order is received.
In any cases of anomaly (problem linked to transport, error in the items delivered, damaged item delivered), the customer is invited to contact Rotin-Design as soon as possible.

Nevertheless it must be noted that the furniture sold by Rotin Design is made by hand in artisan workshops; this is what gives it its qualities and personalities.
It can therefore differ very slightly from the photographs presented on our website which have an indicative value. The essential technical features of the items are subject to a description on the site.
A minor difference in appearance would not be considered a defect.

In the event that a defect on an item of delivered furniture has escaped Rotin-Design's vigilant checks, or if an error occurs when making up the delivery, the after-sales service will act as quickly as possible to exchange the product.

The items must be returned within 14 working days (unless agreed otherwise with After Sales Support) after the date on which the products were received, in their original packaging, in the same condition as that in which they were received and accompanied by any documents such as instructions and documentation.
The return labels must not be attached to the products or the original packaging but to the complementary packaging in which the return must be made.
If this period expires over a weekend or a national holiday, it is extended until the next working day.

Items that have been used, spoiled or damaged since they were received cannot be accepted for returns.
For returns following an error for which Rotin-Design could be responsible, the After Sales Support will offer to pay for the fees to return the items.

Customers can request reimbursement or exchange as part of a new order. After verifying the condition of the returned items, Rotin-Design agrees to reimburse the customers within 14 days or to deliver the new order requested under standard delivery conditions. If this new order is for a different total, the customer will have to pay the difference for a more expensive order or will be reimbursed with the difference for a cheaper order.

7 - Cooling-off period

However if the customer has changed his/her mind since ordering, or if upon receiving the items they are not suitable, (s)he has the right to a cooling-off period.

This right can be exercised for a period of 14 working days.
Customers are invited to inform Rotin-Design of this by mail (postal or electronic), over the telephone or by fax as soon as possible by filling out the withdrawal form, available here. As soon as the form is received, S.A.S Sodima must send acknowledgement of receipt.

The customer can cancel his/her order if the items ordered have not yet been entrusted to the courier.

If the items have already been dispatched, after receiving the order the customer must return the unsuitable products in their original packaging at his/her own cost.
This 14 day period runs from the date the products are delivered. If this period expires over a weekend or a national holiday, it is extended until the next working day.

The items must be returned in their original packaging, in the same condition as that in which they were received and accompanied by any documents such as instructions and documentation.
The return labels must not be attached to the products or the original packaging but to the complementary packaging in which the return must be made.

8 - Liability

Rotin-Design cannot be held responsible for any type of material, immaterial or physical damage which could result from the improper use of the products sold. 
Rotin-Design cannot be held responsible in an event where the failure to execute its obligations is attributable to either an unforeseeable and insurmountable action of a third party to the contract or to a case of unforeseen circumstances or force majeure as defined by French jurisprudence. 
Likewise, Rotin-Design cannot be held responsible for any harm or damage inherent in the usage of the Internet network (service interruption, external intrusion etc.).

9 - Data protection

The information requested from the customer is necessary for the processing of the order and its delivery.
It is destined for the sole usage of Rotin-Design.
Customers can receive information about new products or promotional offers from Rotin-Design at the address provided when the order is placed.
In these letters, customers will have the option to request their removal from the Rotin-Design mailing list.
The processing of nominative and/or personal data gathered on the site has been subject to a declaration to the CNIL (National Commission on Informatics and Liberty) under the number 1489379 dated 25 March 2011.
In accordance with the Data Protection Act of 6 January 1978, on information technology, data files, and civil liberties, at any time, customers have the right to access, correct, and remove any data pertaining to them by writing to Rotin-Design.

10 - Disputes

This Contract shall be governed by French law.
In case of dispute, the relevant court will be that of the place of the defendant's residence or, at the plaintiff's choice, that of the place of the effective delivery of the product.

In case of difficulties in the application of the present contract, the purchaser has the option, before any legal action, to reach an amicable solution particularly with the help of a professional industry association, a consumers' association or any other consultant of his/her choice. 
It must be noted that finding an amicable solution does not suspend the period of the legal guarantee.

Even if the Rotin-Design site is accessed from another country, only conformity to French law is applicable to orders made on this site.
